Participants may utilize or obtain quizzes, surveys, services, products, and data (“Services”) provided by BestQuotes.com through BestQuotes.com.com (and affiliated websites). BestQuotes.com (and affiliated websites) is a Web site that offers a range of quizzes and surveys for participants to take part in and is owned by FourPeople Inc. and ReviMedia Inc. Such data collected include receiving and storing participants’ opinions and statements about their behavior. Participating in quizzes or surveys from BestQuotes.com will require filling out the personal information of participants.

BestQuotes.com is only willing to make the Services available to participants if participants accept and abide by these Terms and Conditions. By utilizing or obtaining the Services, participants enter into a binding legal agreement between participants and BestQuotes.com, consisting of these Terms and Conditions. If participants do not agree to any provision of these Terms and Conditions, participants should not utilize or obtain the Services. The Services allows participants who are eligible to register for its quizzes and surveys. BestQuotes.com does not guarantee the honesty, quality, integrity, or suitability of any of the Services created for our participants and the Services created by sponsors or affiliates. BestQuotes.com is not representative of any of the content on BestQuotes.com.

MODIFICATIONS TO THE SERVICES

BestQuotes.com may modify or end the Services, or any part of it, temporarily or permanently at any time. By accepting these Terms and Conditions, participants agree that BestQuotes.com will not be held liable either by any third party or you as a participant if the Services should become modified, suspended, or end. BestQuotes.com holds the right to copy, re-use, and/or reproduce any of the content on BestQuotes.com.

Participants agree that BestQuotes.com does not guarantee: the quality of the Services purchased or obtained by participants through the Services meets the participants’ expectations; the results achieved by using the Services are correct or reliable; and errors in the Services will be corrected.

THIRD-PARTY SERVICES

The Services may contain sponsor(s), (affiliate) link(s), co-registration(s), or integrated content to BestQuotes.com provided by third parties (collectively, “Third-Party Services”) for all participants. BestQuotes.com cannot be held responsible for acts by Third-Party Services, including (but without limitation) its accuracy, integrity, or wrongful doings. BestQuotes.com does not guarantee the quality of the Third-Party Services received or purchased by participants through the Services.

Participants use any of the Services containing Third-Party Services at participants’ own risk. As you enter the campaign, you will see a series of advertising offers. These offers are optional. You are not required to participate in the offers in order to obtain scores or other information. If you decide to purchase products or services from our advertisers, you will incur associated charges.

TERMINATION 

BestQuotes.com may terminate use of the Services by participants and destroy any data within the Services if BestQuotes.com deems that the participant has not observed these Terms and Conditions or for any other reasons. The participant agrees that BestQuotes.com may erase quiz and survey registration data and all information connected with it as well as any data used by Third-Party Services without delay, and/or deny the participant all further access to the Services. Prior notice is not required in the event of termination of the participant’s access to the Services.

CONSENT TO FUTURE COMMUNICATIONS AND EMAIL OFFERS

When the participant uses the Services, the participant agrees that BestQuotes.com may contact its participants with future communications (but not limited to) email marketing, telephone marketing, and direct marketing, as well as online and offline advertising. BestQuotes.com may share the participants’ information with third parties for marketing purposes, unless participants opt out, as described in the BestQuotes.com Privacy Policy. Such communications from BestQuotes.com may be transmitted to participants by (automatic) telephone calls, email offers, quizzes, or any other method of communication. Please see the BestQuotes.com Privacy Policy for data regarding BestQuotes.com’s collection, use, and disclosure of this information http://www.bestquotes.com/privacy. By using the Services, the participant accepts and agrees to that Privacy Policy.

REGISTRATION REQUIREMENTS

Use of the Services require that participants represent that they are of legal capacity to enter into a binding agreement and are not persons barred from receiving services under the laws of the United States or other applicable jurisdiction. In addition, participants attest that any personal information collected from the participants by the Services is correct and complete. The participant ensures that registered information is correct, up-to-date, and complete at the time of participation. If BestQuotes.com has a reasonable suspicion that the registered information is not accurate or complete, then BestQuotes.com is entitled to delete the participant’s data and to withhold all future use of the Services.

The Services may be used only by persons eighteen (18) years of age or older.
The Services are available only to residents of the forty-eight (48) continental states and the District of Columbia. Void in AZ, CO, CT, IA, MD, ND, TN, and VT and where otherwise prohibited by law.
The Services are not intended for participants under 18 years of age. Use of the Services is void where prohibited.
By using the Services, participants represent and warrant that they meet the eligibility requirements in these registration requirements and are fully able and competent to enter into and abide by these Terms and Conditions.

FEES FOR THE SERVICES 

There is no fee to participate in the Services. At any time, BestQuotes.com may decide to charge fees for the Services or Third-Party Services. If BestQuotes.com decides to charge fees, these Terms and Conditions will be modified. In order to make use of the Services, participants are required to have access to the (mobile) Internet through an (mobile) Internet Service Provider. Participants are required to pay all expenses involved in such access to the Internet. Participants are also responsible for the connection of any necessary equipment, including (but not limited to) mobile telephone or computer. BestQuotes.com accepts no liability for the failure or malfunctioning of the personal equipment of its participants.

COMMERCIAL ENDEAVORS

BestQuotes.com is for personal use only. Organizations and businesses may not become participants and should not use the Services or BestQuotes.com for any purpose. You hereby agree not to reproduce, copy, sell, resell, or use the Services (or any part of it) or access to the Services for commercial purposes.

TRADEMARKS

All service marks, trademarks, logos, trade names, slogans, and domain names that appear on or in connection with the Services are the property of BestQuotes.com or its affiliates, licensors, or licensees. You may not copy, sell, re-sell, reproduce, display, or use any of these trademarks without prior written consent of BestQuotes.com.

COPYRIGHT PROTECTION

The data, data feeds, content, organization, graphics, designs, and other material featured on BestQuotes.com or provided through the Services (the “Copyrighted Material”) are protected under applicable U.S. and international copyright, trademark, and other intellectual property laws. The Copyrighted Material is either owned by or licensed to BestQuotes.com. It is forbidden to copy, sell, re-sell, reproduce, display, or use the Copyrighted Material without prior written consent of BestQuotes.com. All rights are reserved.

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND UNDER THESE TERMS AND CONDITIONS, BESTQUOTES.COM IS NOT SUBJECT TO WARRANTIES, EITHER IMPLIED OR EXPRESSLY STATED (OF ANY KIND), INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES WITH REGARD TO SUITABILITY, MERCHANTABILITY, FOR A SPECIFIC PURPOSE AND/OR VIOLATION.

PARTICIPANTS AGREE TO USE THE SERVICES AT THEIR OWN RISK. BESTQUOTES.COM MAKES NO WARRANTIES OR GUARANTEES THAT THE SERVICES OR BESTQUOTES.COM WILL BE WITHOUT ERROR OR NOT BE INTERRUPTED. PARTICIPANTS AGREE THAT THEY BEAR RESPONSIBILITY FOR ANY DAMAGES INCURRED AS A RESULT OF DOWNLOADING OR ANY USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, BESTQUOTES.COM, AND CONTENT ARE PROVIDED TO PARTICIPANTS ON AN “AS IS,” “AS AVAILABLE,” AND “WHERE-IS” BASIS.

THIRD-PARTY SERVICES DISCLAIMER

ANY COMMUNICATION(S), TRANSACTION(S), OR DEALING(S) WITH THIRD-PARTY SERVICES ARE NOT THE RESPONSIBILITY OF BESTQUOTES.COM (INCLUDING, BUT NOT LIMITED, TO ANY SERVICES USED BY SPONSORS, AFFILIATES, CO-REGISTRATION, AND INTEGRATED CONTENT). THE MAXIMUM TOTAL LIABILITY OF BESTQUOTES.COM TO YOU FOR ALL CLAIMS UNDER THESE TERMS AND CONDITIONS (WHETHER IN CONTRACT, TORT, OR OTHERWISE) FOR ANY AMOUNTS PAID BY BESTQUOTES.COM TO YOU UNDER THESE TERMS AND CONDITIONS IS 100 UNITED STATES DOLLARS ($100 USD).
UNDER THESE TERMS AND CONDITIONS, PARTICIPANTS AGREE TO THE STATED PROVISIONS AND ASSUME RISK FOR USE OF THE SERVICES. THE LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, AND OTHER CLAUSES RESTRICT ANY RESPONSIBILITY OF BESTQUOTES.COM FOR DAMAGES INCURRED. ALL PROVISIONS STATED IN THESE TERMS AND CONDITIONS ARE INDEPENDENT OF OTHER PROVISIONS. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

INDEMNIFICATION

Under these Terms and Conditions, participants undertake to indemnify BestQuotes.com and its parent companies, subsidiaries, affiliated and related companies, and each of their respective directors, officers, agents, representatives, and employees against any claims or demands by third parties, including all costs incurred for legal assistance, which claims or demands emerge from any information participants have provided through the Services or any violation committed by participants of the Terms and Conditions or rights of others. Any laws that may limit the efficacy of the provisions under these Terms and Conditions shall be hereby waived by the participants.

LIMITATION OF ACTIONS

Participants acknowledge and agree that, regardless of any statute or law to the contrary, any claim or cause of action participants may have arising out of, or relating to, participants’ use of BestQuotes.com or affiliated sites or the Services must be filed in the State of New York.

ARBITRATION, GOVERNING LAW, AND FORUM FOR DISPUTES

With respect to the laws governed in the State of New York, U.S.A., BestQuotes.com and its participants hereby agree to comply with all rules, regulations, laws, and statutes. Participants will not violate any such orders nor cause BestQuotes.com to be in such violation of any state and federal laws.
In the event that any such claim should arise, all claims will be represented on an individual basis only and will not be consolidated with any other individuals, companies, or parties. Should claims be issued, those must be settled in accordance with the American Arbitration Association. All claims must be presented within one (1) year of the issuance of the claim and will only be settled by binding arbitration.
All arbitration will be arbitrated upon in the City of New York, N.Y., and the judgment and awards from the arbitration will be deemed as final without appeal or review unless as permitted by the laws of the State of New York.

USE OF BESTQUOTES.COM OR THE SERVICES OUTSIDE OF THE UNITED STATES

BestQuotes.com and the Services are intended for use within the United States, if not explicitly stated within contest rules provided. International use can only be considered if such contest rules include use outside of the United States. As per the Registration Requirements listed in these Terms and Conditions, there are some states within the United States that are limited from participation. If participants from locations outside of the United States or within states and territories that are void of participation (see the Registration Requirements above), then those participants chose to participate in the Services or access any of the content on BestQuotes.com or Third-Party Services at their own risk. Participants accept all risk associated with use of the Services and assume to comply with the laws and regulations within their own jurisdictions.

MISCELLANEOUS

BestQuotes.com reserves the right to publish additional contest rules, guidelines, and promotional conditions to the Services. Participants will comply with such additional rules which are subject to these Terms and Conditions and are an inextricable part of these Terms and Conditions. Participants hereby agree to these Terms and Conditions and the additional rules and conditions of any contests or promotions by BestQuotes.com.
No guarantees, which are not stated in these Terms and Conditions, will pertain to any of the Services nor will participants hold BestQuotes.com liable to any content on BestQuotes.com, oral or written communications, hints, or advice from the Services. Content or advertisement for BestQuotes.com found on other Web sites are also not guaranteed by correctness and accuracy nor is BestQuotes.com responsible for any hints or advice in terms of such promotions or advertising in any form of communication.
These Terms and Conditions take the place of all previous agreements between participants and BestQuotes.com. Only BestQuotes.com can modify these Terms and Conditions and such modifications shall appear in writing. Should a court decide that any part of these Terms and Conditions are invalid, then those provisions only shall be revised under a court of law while all other provisions within these Terms and Conditions shall remain in effect.

UPDATES TO THESE TERMS AND CONDITIONS

Periodically, BestQuotes.com may modify these Terms and Conditions, which such modifications will be noted by the latest update date listed at the bottom of these Terms and Conditions. It is the responsibility of participants to monitor and review these Terms and Conditions to stay abreast of any changes made. In agreement with the provisions set by these Terms and Conditions, participants agree to the updates listed, and will comply with all modifications in these Terms and Conditions.
